各省、自治区、直辖市及计划单列市、副省级省会城市人民政府，国务院有关部委、直属机构：
根据《国务院关于深化企业职工养老保险制度改革的通知》（国发〔1995〕6号）的要求，为进一步完善企业离退休人员基本养老金的正常调查机制，经国务院同意，现就1997年调整企业离退休人员基本养老金问题提出以下意见：
一、1997年调整基本养老金的范围为1996年12月31日前已办理离退休手续的企业离退休人员。
二、1997年调整基本养老金的基数：1996年离退休的人员为办理离退休手续时核定的离退休金数额，1996年以前离退休的人员为按照劳动部、财政部《关于1996年调整企业离退休人员基本养老金的通知》（劳部发〔1996〕346号）调整后的离退休金数额。调整
的总体水平：一般为1996年当地职工平均工资增长率的40——60％，特殊情况下也可低于40％。具体调整比例，由各省、自治区、直辖市根据实际情况确定。
三、要通过调整基本养老金，减缓物价上涨对离退休人员生活的影响，保障企业离退休人员的基本生活，使不同群体人员养老金水平进一步趋于合理化。调整中，应注意向养老金水平较低的群体适当倾斜，对近年来因工资、养老保险等各项改革措施出台而增加待遇较多群体人员可以小
幅调整或暂不调整。
四、1997年企业离退休人员的基本养老金的调整时间，原则上定为7月1日。
五、调整基本养老金所需费用，凡参加养老保险费用社会统筹的，从统筹基金中解决；未参加社会统筹的，按原资金渠道解决。要严格控制企业养老保险缴费比例，各地区不得以调整基本养老金为由提高或变相提高企业缴费比例。
六、经批准实行养老保险系统统筹的部门和单位，也按上述精神执行。
七、调整基本养老金关系到企业离退休人员的切身利益，各地、各部门要精心组织实施，尽快落实到位。对执行中出现的情况和问题，请及时报告劳动部、财政部。

各县、区人民政府，市政府各部门，市属各单位：
《兰州地区下岗失业人员小额担保贷款办法》已经市政府同意，现予印发，请遵照执行。
兰州地区下岗失业人员小额担保贷款办法
为了认真贯彻执行中国人民银行兰州中心支行、甘肃省财政厅、甘肃省经贸委、甘肃省劳动和社会保障厅转发中国人民银行、财政部、国家经贸委、劳动和社会保障部《关于印发〈下岗失业人员小额担保贷款管理办法〉的通知》精神，结合兰州地区实际情况，特制定《兰州地区下岗失业人员小额担保贷款办法》。
一、担保基金的来源
1、由市财政局安排一定数额担保基金，分次注入。
2、申请省财政厅下拨部分担保基金，并争取给予兰州市下岗失业人员小额担保贷款一定比例反担保。3、年末依据兰州市对中央、省属企业下岗失业人员提供担保贷款总额的比例，申请省财政对担保基金给予适当补助。
二、担保机构的设立
1、由兰州市中小企业信用担保中心承担兰州地区下岗失业人员小额担保贷款担保业务。
2、由兰州市经委临时借调有业务专长的干部到担保中心帮助开展此项工作，并解决相应办公条件。
三、担保业务的开展
1、各商业银行与担保中心签订合作协议，按协议要求开展此项工作。
2、担保贷款风险责任原则上主要由担保中心承担，具体合作条款由合作双方共同协商订立。
3、各商业银行承办下岗失业人员小额担保贷款代偿率达到20%时，应暂停此项业务，待采取措施并经批准后，方可恢复此项业务。
四、担保贷款的对象和条件
凡年龄在60岁以内、有兰州地区城市户口且有固定住所、身体健康、诚实信用、具备一定劳动技能的下岗失业人员，自谋职业、自主创业或合伙经营与组织起来就业的，其自筹资金不足部分，在贷款担保机构承诺担保的前提下，可以持劳动保障部门核发的《再就业优惠证》，向商业银行或其分支机构申请小额担保贷款。
五、担保贷款的程序和用途
1、由本人申请，所在社区推荐。
2、贷款申请由其所在地各县区劳动和社会保障局初步审查后，报兰州市劳动保障局复审。
3、按贷款项目的所属行业，由市经委和市商委审核其可行性。其中工业项目由市经委审核，商业项目由市商委审核。
4、担保中心负责审核。
5、银行核贷。商业银行自收到贷款申请及符合条件的资料之日起，应在三周内给予贷款申请人正式答复，决定发放与否。借款人应将贷款用作自谋职业、自主创业或合伙经营和组织起来就业的开办经费和流动资金。
为简化手续，申请、推荐、审查、审核、担保、核贷实行一表制，但担保合同与贷款合同按规定由当事人与经办行、担保中心另行订立。
六、担保贷款的额度及期限
小额担保贷款金额一般掌握在两万元以内，还款方式和计结息方式由借贷双方商定，对下岗失业人员合伙经营和组织起来就业的，可根据人数适当扩大贷款规模。贷款期限一般不超过两年，借款人提出展期且担保人同意继续提供担保的，商业银行可以按规定展期一次，展期期限不得超过一年。
七、担保贷款的利率与贴息
1、小额担保贷款利率按照中国人民银行公布的贷款利率水平确定，不得向上浮动。
2、从事微利项目的小额担保贷款由中央财政据实全额贴息，展期不贴息。微利项目是指由下岗失业人员在社区、街道、工矿区等从事的商业、餐饮和修理等个体经营项目，具体包括：家庭手工业、修理修配、图书借阅、旅店服务、餐饮服务、洗染缝补、复印打字、理发、小饭桌、小卖部、搬家、钟点服务、家庭清洁卫生服务、初级卫生保健服务、婴幼儿看护和教育服务、残疾儿童教育训练和寄托服务、养老服务、病人看护、幼儿和学生接送服务。
八、担保贷款的服务
商业银行要简化手续，为申请贷款的下岗失业人员提供开户和结算便利。因申请人不符合贷款条件而不能提供贷款的，应向申请人说明理由，提出改进建议，并将有关情况定期向上级行报告。贷款期间，贷款银行要定期与借款人联系，了解其资金使用和经营情况，提供必要的财务指导。担保中心对兰州地区下岗失业人员小额担保贷款提供无偿服务。
九、担保贷款的监督与审计
下岗失业人员小额担保基金的使用及担保业务的开展，由兰州市经委监督指导。担保中心应定期向下岗失业人员小额贷款工作领导小组汇报工作。由市财政局和市经委组织人员，定期对担保基金的使用情况进行审计。
